The Evolution of the Stroller

Today, parents from all over the world are using baby strollers for their children. These strollers are often designed to be taken off road, with larger tires and independent suspension. The strollers of today, are great for taking your child on a jog or run and are far different from the first strollers, which were invented almost three hundred years ago.

In the East, cloth slings and devices similar to baby backpacks have long been used to transport babies, but the West has long relied on the stroller. A stroller is a baby carrier that traditionally had four wheels and a compartment to hold a baby. The stroller is pushed in front of the parent and often has a built in suspension system, to sooth the baby and also reduce the impact of bumps on the road.

The first stroller is usually attributed to a garden architect named William Kent. The Duke of Devonshire had asked Kent to find a way to make transporting his children easier. Kent constructed what would become the first stroller, which consisted of a basket mounted on wheels. This first stroller was intended to be pulled by a small animal, like a goat, and was very elegantly decorated.

By the middle of the eighteen hundreds, several manufacturers were creating baby carriages that could be pushed by the parents. These usually used a wicker basket to hold the baby and brass joints. As time progressed there were several other innovations. Towards the end of the eighteen hundreds, a man by the name of William Richardson patented the reversible stroller, which allowed the baby to be placed facing towards or away from the person driving the carriage. He also changed the way the axle controlled the wheels, which helped to make the devices much more maneuverable, because each wheel operated independently.

The popularity of would blossom in the twentieth century as they became affordable for more people. New safety features were also added, like brakes, stronger frames, and bigger wheels. As the devices increased in popularity, they could be found in almost everyone's home.

Another innovation to the design of the baby stroller came at the hands of Owen Maclaren, who was an aeronautical engineer. Owen's daughter mentioned that she had difficulty traveling with her baby stroller. Using his aeronautical background Maclaren was able to create a lightweight foldable stroller. He used an aluminum frame and created what would become known as an umbrella stroller. He founded his own company to sell these strollers, which quickly became incredibly popular.

Products Liability Law - Defective and Dangerous Products

WHAT MAKES A PRODUCT DEFECTIVE?

Clients often sit down with me at an initial meeting, describe their accident and a feature or component of a "product" and ask "do I have a case?" The answer to that question most often turns on whether the product or its component can be characterized as "defective". A recent product recall by a large manufacturer provides an excellent learning tool on this topic.

In November, 2009, Maclaren, USA, Inc. issued a "voluntary" recall of several models of "umbrella" style baby strollers. As designed, manufactured and sold, the strollers had exposed "shear points" at the hinges. This design defect caused twelve reported cases in which infants' fingertips were amputated in the shear point. According to news reports, these strollers were manufactured in China and distributed by Maclaren USA, Inc.

Under Pennsylvania and New Jersey law, product defects fall into three general categories:
(1) Design defects;
(2) Manufacturing defects/aka malfunctions; and
(3) Failure to warn.

The Maclaren baby stroller defect is a classic example of a design defect. A product is defective when it contains any component or feature which makes it unsafe for its intended use or anticipated misuse, or if it is lacking any feature necessary to make it safe. The exposed shear point obviously is a feature which makes the stroller unsafe. This is a classic "design defect" case.

Products are defective due to a "manufacturing defect" or "malfunction" when there is a flaw in the manufacture or construction of the particular product involved in the accident. A hypothetical example is a lightweight aluminum product such as a bicycle handlebar. Some of these products are designed to be as light as possible. The design involves portions of the handlebars which have very thin aluminum walls. These are generally safe if the manufacturing process is perfect. However, if an air bubble, grain of sand or other impurity gets into the aluminum at a stress point, this can cause a sudden, catastrophic failure of the bar. While the design is arguably sound, the presence of the flaw in the manufacturing process of the particular item makes that product defective.

Another way in which a product can be deemed defective is the failure to warn of potential dangers in the use of a product or the failure to provide the proper instructions as to the product's safe use. An example here would be a manufacturing machine that has moving parts that can snag on loose clothing such as shirtsleeves or frayed work gloves. While such a product would likely be deemed defective in design, the failure to warn the users to avoid loose clothing and frayed gloves could also be considered a defect.

The examples of product defects are as varied as products themselves. Placing an emergency stop switch more than an arm's length from an in-running pinch point on an industrial machine is a design defect. Designing a child's toy with small pieces that can break off and choke a child is a design defect. Designing a farm tractor without an operator presence control that would shut the engine down if the operator left the operating station of the tractor is a design defect.

A wooden stepstool which is perfectly proper in design is defective if insufficient glue is used to assemble it. Metal scaffolding materials are defective if the welds are improper, causing the framing to fail under stress.

With the increasingly global nature of our economy, more and more products and component parts are being manufactured in foreign countries where labor costs are very low. Quality control systems in these countries and these factories are often below United States standards. With this, the incidence of manufacturing defects and malfunctions increases.

Also, big box discount stores often sell low price products that are designed and manufactured overseas. These products are often packaged with the intention that they will be sold in many countries. Sometimes, the warnings and instructions are formatted in such a way to have application in many countries which speak many languages. This can result in instructions and warnings that are very difficult to understand. This can constitute a warnings defect.

Bottom line, it is difficult to provide a universal description of a product defect. Each case, and each product, ordinarily must be evaluated on its own terms. An experienced attorney familiar with products liability law will often be able to give you a preliminary evaluation of whether a product is or is not "defective". However, the opinion of a qualified expert witness or consultant is sometimes required before even a preliminary opinion or evaluation of a given case can be given.

History of Baby Stroller

After World War I the baby boom also sparked a boom in the baby carriage market. Foot brakes, shopping baskets and stylish shapes were incorporated in pushchair designs. Also the earlier wooded and wicker models gave way to chrome plating, rubber and plastic parts. Baby carriages became a middle-class buy only in the 1950s. Owen Maclaren came up with a compact design for a baby buggy for his daughter in 1965.

The baby jogger stroller followed soon to help the busy parent who did not want to leave the baby alone at home while going to the grocery store. Baby stroller joggers were redesigned with shopping trays and extra compartments to keep goggles, purses, diapers etc.

Here are seven quick tips to handling those situations when children lose control of themselves and let their emotions get the best of them.

1. Please Do not give in to the request. No matter what. Never bribe or cater to their demands. That will only encourage more misbehavior. The tantrum must not achieve the goals it is designed for. If they do, then you are a hostage. The temper tantrums will return and being a parent will become even more of a challenge.

2. Remain calm and do not lose your temper. Being a parent means having a whole lot of patience, self discipline and restraint. There is really nothing you can do at the time the temper tantrum is in full swing. If you could, then tantrums would not be so difficult to deal with in the first place.

3. If you are in public do your best to just ignore what you think public opinion might be. This is ultimately the leverage they have over you. Just know that if no one does that it is going to be okay. Even if some poor misguided soul tells you to just give them what they want, do not listen to them. 4.Do not try to reason with your tantrum throwing child. Do not allow the tantrum to allow any kind of attention power. Show that this is not the way to make any kind of plea. This is not the way people communicate. Your child will not listen anyway. The key is to try to avoid the tantrums and prevent them from happening again.

5. Find a safe place to let it play out. If you are in public you may have to leave. If you are at home have a place where they cannot hurt themselves or anyone else(or anything). Give them the time they need to get it all out of their system. Try to explain to them how much this bothers you. Let them know you love them but that you will not be a part of this kind of behavior. Then leave them but stay right outside of their room. As soon as the screaming yelling and crying stop, then(and only then) return.

6.The angry love big bear hug. If you need to restrain your tantrum throwing angry little child just gently get a hold of them and hug them tight enough to keep them from harming themselves. Most children do not respond well to being held down and will stop very soon after your hold has taken them. It is a reassuring feeling of comfort and love. This makes it very difficult for them to keep up the madness.

7. Being a Parent means you should offer them alternative methods to managing their anger. After the tantrum do not give them their desired result and explain why. This is where many parents make their mistake. Giving them what they wanted after they have calmed down is confusing. With one exception, it worked. They will ultimately carry home the message of it only took me a little longer but I got what I wanted.

When there are temper tantrums to deal with when being a parent it can make you feel like there is something wrong. Truly though, this is just not the case. Many children, alright most children at some point or another throw a temper tantrum. It is their beginning of learning how to handle emotions. Children are like little people with big wants.
